Ложная аналогия. В первом случае бездействие не означает гибель всех. Во втором, именно это и означает. Первый выбор - обусловлен обществом и может быть разрешён на этом уровне. Второй - биологией и не может иметь решения при нынешнем состоянии дел в медицине.

Обоих сторон. В первом случае это нападающая сторона и обороняющаяся. Во втором противопоставляются мать и ребенок. Что, кстати, ещё один признак ложности аналогии.

Similar to when an accomplice dies during the commission of a felony. The co-felon is charged with murder. In this case, any harm incurred by the fetus is the responsibility of the mother.

Now, admittedly, that sounds cold. But still, when the woman involved is unrelated, the choice is easy. I owe my life to my wife and family more than to an unknown person.

On the other hand, if the woman involved were my daughter, well, I'd probably do everything possible to avoid deadly force. If I couldn't avoid it, I'd try to "shoot to wound", or try to knock her out so as to give both her and the child the best chance. And feel like crap afterwards, regardless. There's no winner in that circumstance, just degrees of losers.
