That's either really sloppy of DC/Marvel, or it was an agreed "whatever we give up." Defending that trademark over the years must have cost them a shit ton, and these days it's probably next to impossible given how far the word has spread culturally. Maybe they just finally decided it was costing more than it was saving? Doubt other people using the word can hurt them much at this juncture
