jk, but for real, I have zero sympathy for this man. None. He couldn't just hire a driver for the evening? He absolutely had to drive his own car? No. Fuck that noise. I can't believe they're really gonna try this "Poor Justin, he's in a dark place" bullshit. Okay, and that gives you a free pass to drive under the influence? He's lucky he didn't kill anyone.

This is the point of refusing the breathalyser - it's the objective evidence and there's not a lot of room to try to contest it. Everything else (the officers' recollection of how you were, their take on whether you were over the limit) is subjective and an attorney can at least try to pick holes in it. (Edit: they don't have to accuse the officers of outright lying, just of being mistaken/jumping to a conclusion)

Of course the more of those observations stack up, and the more exaggerated the behaviour, or the officers have camera footage that backs their take, the less likely you're convincing anyone. But it's pretty much your one play to try beating the charge unless the officers committed some procedural faux pas that'd get it tossed out
