Oh, there is a difference between DWI and DUI; I thought the first was a weird typo off the latter.

Driving While Intoxicated (DWI) means alcohol only

Driving Under the Influence (DUI) means drugs or both drugs and alcohol.

It actually differs between states! It’s usually different BAC levels, though. In NY, DWI is above .08, and DWAI is .05-.07, and they’ll specify alcohol drug, or both. In my state, DWI is below .08 and/or on drugs, and DUI is the more serious charge for >.08. In Texas, DUI is for minors and DWI is for adults >.08. California just uses DUI.
