I’m not a lawyer but based on the two OJ Simpson trials, I think yes. The burden of proof is lower in a civil case.

Yes. The standard of evidence in civil matters is a "preponderance of the evidence" which is a fancy way of saying "from the evidence presented, does it seem like the defendant did it?". Criminal matters require more certainty with it's "beyond a reasonable doubt" standard.

He and Hils really aren’t doing themselves any favors PR wise. A simple, well crafted statement would have been the way to go. But those photos are just so inconsiderate and inappropriate for the moment. Being glad charges were dropped is a normal reaction, but the posed photos that are one part martyr-ish, one part just damn weird, is just so insensitive to the families of the victims.
