Lawyers of ONTD, please correct me if I'm wrong, but an increase to 1st degree would almost certainly result in acquittal. They would need to prove pre-meditation in addition to intent, which unless there is indeed some shared history between the two (akin to what's been popping up but remains unconfirmed) I think premeditation would be very hard to prove beyond a reasonable doubt.

I hope they only do so if they have the solid evidence for it to get a conviction. 2nd degree will be much easier to prove since all the evidence needed for that is on the video. 1st degree would need more evidence than they currently have as far as I am aware.
