After doing some more research on IL Law, R. Kelly can go to jail if his judgement says that he has to pay damages.
R. Kelly got served summons but did not show up in court (default judgement).
Before judgement, you can't go to jail in IL. However, once you receive summons, it's an invitation to appear. However, post judgement which we are at now in his civil case because he didn't appear in court.
Subsequent hearings on this civil case, R. Kelly must appear. If they do not appear in the subsequent hearing, he can be held in contempt of court. This means he can get an arrest warrant issued for their arrest. The term for this is "body attachment" which means if you are a debtor in a collections case you can go to jail because you did not show up to the court ordered court date.
So, R. Kelly can go to jail for this civil lawsuit.
I'm legit shocked because it's not a secret that if you don't go to an ordered court date, a warrant is filed for your arrest. My friend went through something similar in small claims court.
