Your Ex would have to prove that Laurel lived with him for 6 months or more to claim her on his taxes.

Also, no matter what H does with his taxes, the general rule is that you still have to be honest. If you are required by law to claim L, you must. If it's optional, and she qualifies as a "dependent", then you can, no matter what anyone else does. I'm not totally up to speed on my tax law, but I think that the qualifiers for dependents are set up so that pretty much only one person should be able to claim her. Generally, you don't have to avoid claiming her, if you qualify, solely because you think H is going to file a fraudulent return claiming her. When the audit comes, your return is true, his is false, and he's the one who gets spanked for it.
