Heh, here's a letter that I just wrote that will be faxed to DBS tomorrow. This is the 3rd chargeback on my debit card in 3 years that I'm disputing. I hate it when companies try to challenge the customer. I know my rights, and will use the law against you if you don't abide by proper business ethics.

On 18 Feb 2005, I made a payment of $100.05 for 3 months worth of web hosting service at
http://www.brinkster.com for the period 14 Feb 2005 - 13 May 2005. I made my cancellation in early April, and the cancellation was confirmed on 5 April 2005 (see attached). My domain name is ‘fantasysquare.com’.
I contacted live chat support on
http://www.brinkster.com and they told me that my refund for any unused period will be credited back to my card, which is a total of 1 month and 8 days. However, the billing department out rightly refused to issue a pro-rated refund for me (see attached).
According to their terms of services, we are entitled to a refund for unused periods. Their TOS is located at
http://www.brinkster.com/AboutUs/TOSShared.aspx Under Section 4.09 (Exact as of 17 April 2005)
If a customer cancels their hosting service prior to the end of the Initial Term or any Renewal Term thereafter:
(a) customer shall be obligated to pay all fees and charges accrued prior to the effectiveness of such cancellation,
(b) Refunds of service fees will be made only for pre-payment of service fees beyond the next renewal period following the effective notice and termination of this agreement. All refunds shall be pro-rated based upon the number of days for which service remains unused as of that next renewal date. Brinkster may grant refunds under any other circumstance it deems appropriate without waiving any other rights hereunder. There will be no refunds of Domain service Fees. Fees paid for certain additional services, including but not limited to services for extra storage space, web mail tools or special groupware, are also not refundable.
I believe the total amount owed to me for the refund is $42.24 (rates based on 1 month 8 days).
I trust that DBS will take the necessary steps to settle this chargeback and rebate the amount back to my account as soon as possible.
