One thing Bush did for both candidates: he set the bar really, really low. If anything, his administration proved that while you can beat the system into broken and bleeding state of unconsciousness, you can't kill it. It's also where liberals will have to decide whether or not they want to place as much emphasis on electing and maintaining a Democratic Senate as they do electing and maintaining a Democratic President. If Obama is elected in eight days, then they can ease off on maintaining a Democratic Senate, at least until 2012. If McCain/Palin gets in, then liberals should...remind...Dem Senators of the Constitutional powers they hold.
At worst, this reminding would produce mediocre appointments on the level of Souter, O'Connor and Kennedy. Ideally, it'd produce a Warren, Blackmun, Brennan, etc. Regardless, folks who are concerned about the Supreme Court should focus as much on the Senate as they do the Presidency...
