The VAST amount of funding for medical research comes from the NIH. Yes, there are private research institutes out there that could conduct this research, legally, but again - virtually all of their research is funded federally, so they can't. As for private investors, it's an ugly loop - they won't get involved until they see that it'll yield profits, and there hasn't been enough research to prove that yet, because of the lack of funding to conduct the research
