Now I get word back from Fred Loya Insurance that the guy that was driving the truck is excluded from that insurer on the truck. Meaning he had no right to be driving that truck since he has no insurance.
OK if he is excluded from the coverage I would want to know why? I saw the pictures of the damage and type of vehicle you have, its a Celica appears to be an 87ish model and currently not in tip top condition damage aside. If you take this to court the most you can receive is going to be the judges appraised value of the vehicle based off of Blue book. Being it appears to be a 20yr old car and not in the greatest of shape to begin with your looking at $3000 maximum if you sue. I dunno if thats worth it to you or not.
I would sue the person out of principle. A judge is not going to be likely to find favor with someone skimping insurance and asking 3grand doesn't make you appear like your going to court hoping to make a payday.
