His knee is so badly swollen. I've tied a bandage round it for support and he was holding ice on it for ages last night. I can't believe how bad it is, and the bruise hasn't even come out properly yet.

My supervisor and two solicitors have all said that the two of you should sue.
By apologising the Foreman has accepted blame, the risk should not have been there, and as it has blown down before, they had a duty to ensure the area was safe.
They all recommend that you use a 'no-win no-fee' company, and said that they would expect a decent amount of money (at least £250 each, but probably more)and that the building company will have vast amounts of insurance to cover things like this, and that they will be prepared to settle out of court.
