IF... if the Republican Party followed the rules, a C&D order will likely be denied. About the only way it would be enforced is if the plaintiffs can prove the Republicans are misrepresenting Heart, i.e. giving the impression that Heart endorses McCain/Palin.

Or if they tried to use a sound-alike (which they didn't) like what happened when Ford Motor Company tried to use a Bette Midler sound-alike for a commercial several years ago.
