Well, technically Draco is also a Death Eater. Harry made the choice to support Draco's family when he fell in love with Draco.

Not with what Harry does in the next chapter. And not if he keeps the Malfoys locked up until they're either mentally healthy or Draco sees that letting them go won't do any good.
