Not sure about penalties legislatively speaking, but there are consequences! The Chinese kidnapped some other boy child reincarnated, and replaced him with one of their own. No one knows what has happened to the child. Also the Dalai Lama has said he will be reincarnated outside Tibet next time, so as to avoid another occurrence of this same situation.
