The US Constitution does not need to be replaced or scrapped, as a number of folks on the left have suggested going back to President Woodrow Wilson. It does not need to be cured of its fatal flaws, so that Obama can implement redistribution of wealth and “break free” from the negative liberties placed by the founding fathers to prevent this, as Read more... )

I'm so glad to see your post, and to hear of your path forward.

I believe one crucial check and balance you didn't mention was that Senators were elected by the states, not the people. This gave states a vertical check and balance, as well as the people having a check and balance.

The first thing I would like to see would be repeal of the seventeen amendment.

I sure don't look like the icon anymore. Hair now much thinner, face much thinner, and my beard and mustache were victims of the massive blood loss. Maybe my artist friend can take a shot at this and try not to make me look too scary.

You've been gone so long, you forgot how to format ideally for LJ! :P

the Supreme Court decided that it could determine whether laws were constitutional or not. This is not called out as part of their charter

I had no idea. Of course, since this decision must have been made in part by some of the first Supreme Court justices, it feels much too late to do anything about it.

I don't have much control over that; the last year of posts have similar problems as the cross-posting system is sloppy about paragraphs. But I suspect you're seeing something new. What?

And indeed, many of the original framers of the Constitution were still alive during this case - John Adams caused it by appointing a raft of "midnight judges" favorable to his Federalist party just before leaving office, and the "Madison" in the case name is indeed James Madison, a primary architect of the Constitution. He'd written, years before, of the potential for creeping usurpation by the judicial branch.

But objections did not win the day.

Thank you, sir.

The peripheral nerve damage also affects my digestive tract, and I am hoping to quickly recover to the point of no longer being "seconds from disaster."

But happily, the effect on my vision - my reading glasses went from 1.0 diopters to 2.75 in two weeks - has already receded. I'm pretty much back to normal there.
