Well, Kahlen did say "during a moment of ecstasy", and since a heated make out didn't seem to do anything before, I took the ecstasy part to mean...well...much more of a climatic scenario. Ahem.

Agreed but I don't think Keiren & Vivian knew about that little loophole either. Or, at the very least, Vivian didn't know or why else would she have killed herself if not to "release" Keiren?

This is absolutely the correct answer. And in fact this episode is very clever foreshadowing to what will ultimately be revealed about Richard and Kahlan. At least that's my take on it. I can just see the call back already happening in the future ep when the big reveal happens, if that makes any sense lol.
