Just read in on /. that Microsoft is releasing an alpha release of a new OS called Singularity under an "open source <...> academic, non-commercial license

They refer to the Kurzweil's book.

And the license is not "open source" - it violates "No Discrimination Against Fields of Endeavor" requirement of OSD.
