Keep the pharmacy receipt. I'm sure there's a way to get reimbursed if she's paid for coverage and just didn't have her card yet. If you keep the receipt you can figure it out after she's not totally sick and you're not totally stressed. (Then again, toatlly stressed may help, since I've found crying on the phone to be more effective with HMO reps than rational arguments.)
The insurance deductible seems like a slam-dunk in small claims court if you can muster the time and the filing fee. That's not always easy though, I know. If you do it, be sure to add "court costs" to the amount you sue for, and possibly "loss of income" for any days off work you have to take.
Oh, I'm not worried that we would lose in small claims court if we went that route... I'm more worried that the guy wouldn't be able to pay and we would get a judgment but no $$. I know that if his name is on the police report (haven't gotten it yet), the insurance company might try to go after him. Not sure. But I think we're still responsible for the deductible.
Also, I got a good chuckle about crying to HMO people. I tried that once and I didn't get anywhere, but maybe I'm not a good enough crier.
You are good people. If I knew why it sucked so bad right now, I'd tell you. We hit a streak of suck at the end of 2005-beginning of 2006 that we eventually funked out of.
You'll funk out of it, too. Because you are good people.

I so wish life were the least bit fair.

I know this must not be funny to you, but it was to me- if only because that's about the only good thing I can think of about this situation.
*hugs*

p.s. It would be awfully hard to get to our jobs if we moved to the sticks. So you should procure a high-paying job for my wife and we'll do it.
