Sure, maybe... that's not a very good word to describe anything, it's one of the emotional attack words (at least as targeted on Libertarian types). It's like "Socialist," or "Fascist." It could have actual meaning, but almost never does; it's more often just used for affect.

I'd say that he's more of a "realist" in that he's trying to make a careful decision, well knowing that the future repercussions are unclear but potentially devastating to the US. This stuff is going to play itself out over many years. Obama didn't start it, but he's got to deal with it in terms of everything else.

The courts WILL deal with this stuff, and there WILL be investigations of past actions, but Obama simply isn't going to throw open the doors to the Executive, essentially pressing the button to launch a nuclear can of worms on the world, while simultaneously trying to keep us on a very narrow path between all the other types of meltdown that we're at risk of at the moment.
