It has to do with availability and value.

If internet access wasn't a commodity (ie, cheapest price), you wouldn't have excessive downloading.

When internet access was metered/timed dialup, you used it very careful.

Now it's unlimited, no questions asked, $60 for high speed. $60 is a few beers at a Toronto bar.

If the MPAA wanted to control things, they would buy up the ISPs!
