It's not just that fic, though--it's the ENTIRE journal, right from the first entry. So, he copied over plenty of personal, non-fannish entries and meta entries for which I doubt there's any question of whether they qualify as fair-use. In Principio is just what finally got him busted. So the legal status of fanfiction is not even the issue.

Unfortunately, with LJ abuse washing their hands of the matter--chalk up another win for selective enforcement of the TOS--the only thing left is mob rule. Go, LJ.
