It matters plenty, since O'Connor was a centrist who will likely be replaced by a raging conservative. And given the way that Bush and his minions have been force-feeding their peculiar version of Christianity down our throats, it'll likely be a conservative Baptist or Pentecostal, which means bye-bye First Amendment.
Wow, I don't begrudge you your optimism, but that is really naive.
They have done a lot, and they'll do lots more. As I said in my other comment, this has been a 5/4 court on a huge range of issues. I'm not usually a chicken little type- I'm an optimist, basically. And I do think they are getting close to hitting the wall on public support in various places. But we will be living with the W court-to-be for many many years.
Also, ND just made abortion illegal last year, and that hasn't made it to the court yet. We'll see; in terms of availability of abortions, they've already screwed us. But this is very very far from the only issue.
Brace for a fight - you just know W. is going to appoint someone breathtakingly conservative.
She's certainly earned the right to step down, at her age and after a long and interesting tenure. If you haven't read her book about her childhood (Lazy B), by the way, it's worthwhile, as is her book The Majesty of the Law.
We're looking at least one more appointment after this, possibly two; Stevens is 85 and Rehnquist has cancer, so neither of them is going to on much longer.
The confirmation battle is going to be hideous, and the result will probably be someone who makes Antonin Scalia look like Abe Fortas. And if Roe v. Wade goes down, I AM moving to Canada. Enough is enough.
Well, at least he can't get much worse than Rehnquist. Stevens, however- poor guy. Shoulda stepped down when Clinton was prez, but who knew Al would blow it and folk would fall for Nader and W would get his daddy's mafia to steal?
