I think the classification thing gets down to a difference between stepping on feet and harassment. Whether someone is stepping on my foot is objectively verifiable by external observation in all cases. Whether someone is harassing someone else is more equivocal, and subjective. Whether I personally feel someone else is harassing me can get down to what I understand about their intent.

That's a reasonable point. I think Hershele Ostropoler was getting more at the bit where the person has to get off the foot before that discussion can even begin.
