Hey, he knew you needed it quickly, and if it doesn't come in by tonight, you have to make other arrangements. Call him, and if they don't have it in, tell them that you're very sorry, but you really have to get the fabric by tonight and if they don't have it, you'll have to go somewhere else. If you really don't feel comfortable doing the calling, I will. They can always sell it to someone else.
They'll be able to sell it if it's sold out before. Tell them that you are under a time crunch, and you were not able to wait any more. It was way beyond the estimated day of arrival.
(seriously, 2+ weeks? Where was this fabric, China? Fedex doesn't take that long from ANYWHERE.)
It's like if you order a book from Barnes and Nobel and then find it somewhere else. You buy it and just tell them you don't need it anymore. They don't grumble and gripe, they put it on the shelves and sell it. It's no skin off their noses.
Agree with the above. You are within your rights to purchase alternate fabric. If you are very concerned, just call the store and let them know that you are getting different fabric and why. I'm sure they will understand.
