I do think that funerals are private and not public and there should be some restrictions... especially since you HAVE TO PAY SO FUCKING MUCH FOR THEM. Military funerals are a little different in that they're (mostly) publicly funded, but, seems to me they're military events and there should be some security issue at hand. They may be dead, but they're still owned. I dunno, maybe that's a horrible stretch.

I just can't wait for this asshole to do the wrong thing and either out himself (come on Ted Haggard effect) or end up in jail for a long, long time.

Don't get me wrong, I find the Phelpses as Satan-spawned as the rest of you. But, as long as they stay in public areas, I think they should have the right to protest, just like others have the right to counterprotest. Local, state, and national officials have erected just about as many barriers as they can to block them. I don't know what else they can do without actually infringing on their First Amendment rights. When the day comes (and it is coming) where someone decides to turn the clan into human pinatas, I won't be shedding any tears.
