I'll bring some more. Although it's possible, I don't give summary judgments much hope. I didn't expect it in the civil trial in Alabama, and I really don't expect it here. Though, to be honest, I'd give this one a slightly better chance in favor than the civil case one had.

i was about to submit my feeble hopes that this embarassment sets some manner of precedent, but a year and a half of repeatedly failing game laws hasn't yet, and why should a particularly humiliating one change that...?

The purpose of the Act is to control the thoughts or "psychology" of minors - which is not even a legitimate, much less compelling, state interest.

But, but, only with the prevention of unbellygoodfeel can the state ever hope to save us!

Indeed, the Court has held that the Act "cannot be defended on the grounds that it is designed to protect minors from some form of 'psychological harm,' as that amounts to nothing more than 'impermissible thoguht control.'"

Darn you activist judges! Thought control is the only way to ensure our children do not grow up to be liberals!

You're confusing "liberal" with "Democrat". See, Democrat politicians only act like liberals as a front so they'll get elected. When push comes to shove, they slip back into conservative mode. ;)

Even the Democrats featured on GP whine about "liberal" judges (because their bills get struck down), they just don't use that word. I believe they use "activist".

Interesting points, although enacting legislation designed to interfere with free market forces is a non-conservative approach. True conservatives generally are against regulating trade and commerce/are pro laizzez-faire.

The only sad thing here is that Thompson has managed to convince himself that it's not that this ill-conceived law will never pass Constitutional scrutiny, but that that mean ol' Foti foiled his plans, having taken his blood money from Takestar and talking about unimportant junk like Katrina recovery.

What's this make the industry? 10 for 10?

If so, that's sad. We're a fifth of the way to winning this battle the hard way...
