Trains redux: It's illegal to take pictures of subways and trains in New York, isn't it?

According to this New York Times article, New York cops think it is -- even though they're dead wrong. Not that being wrong stopped them from harassing, arresting and issuing a number of summons to the photographer. I can think of this two ways:

If I really was a terrorist, I'd be using a much less obvious camera.

And the same government that says we should put up with surveillance because "if we have done nothing wrong, we have nothing to hide", well, then they should have no problem being photographed, because they don't do anything wrong, right? (Photographing the police is becoming illegal in England.
