Over on tumblr, I summarized the ruling in this week's SDNY ruling that the play 3C is a transformative work and Fair use, and thus does not infringe on the tv series Three's Company. You can read the full ruling here.
While this ruling might be somewhat more on-point for, say, slashfic writers, it doesn't really seem that different from other similar US court rulings, as this one itself says: "...the more transformative the new work, the greater the likelihood of a finding of fair use."
Would 3C have fared as well if the characters were named Jack, Janet, and Chrissy instead of Brad, Linda, and Connie, with no change in tone or premise?
