7:30-4:30... that's an 8 hour work day with an hour lunch thrown in. That seems perfectly reasonable to me. Hell, if you start working at 6:30, you should be able to leave even earlier. Is disability at all a possibility if she threatens to fire you? I would think that if the DMV had provocation enough to take away your license, then a doctor should be able to say that you need to be on disability until such time as you can drive and work again, right?

Disability insurance isn't giving me a straight answer as to if I am covered or not...

I'm kinda in limbo and it sucks ass.

Is it safe to assume that public transit is a no go?

The closest public transit to me is in clovis.. which is twenty or so miles away.

Wow.

Well I'm glad you're willing to be demanding. You should also take a look at the state and local laws regarding disability accommodations. It's possible she has no choice but to adjust your hours or find another way to accommodate you. The ADA Regulations are pretty tough on employers.

Good luck!

Unless your seizure directly involves your ability to do your job it isn't grounds for anything you are demanding. She also has no requirement to adjust your schedule to accommodate you. This seems to come down entirely to a personal transportation issue and your employer has no responsibility to make sure you can get to and from work. Transportation issues will not allow you a disability claim. This seems to be a big annoyance but it's one of those stupid things in life you work around. From a law standpoint she would be stupid to lay you off and allow you UI and if she has to fire you for dereliction of duty or excessive absence then you aren't able to collect unemployment. I'm really sorry that you're in this situation and it seriously blows, but unless you just do what you have to do to get to work you need to either find another job closer to home or voluntarily leave your position. Your boss has no requirement to make this work for you unless you find a doctor to say you are physically unable to work more than 3 days a week or ( ... )

Understandably, I can somewhat see where what you are saying applies. However, at current, under several definitions I qualify as having a disability. Firing me due to said disability is a sticky situation. Its not an optimal situation for either her or I to be in. Its certainly one that I would prefer to end as amicably as possible.

I can get at least one professional to state that the work hours she's demanding I work would be detrimental to me mentally... so *shrugs* Additionally seizure disorders in general are treated differently then other disabilities due to their nature.

My hope is that she and I can come to a more reasonable understanding regarding this.

I totally sympathize with you, I wake up at 4am everyday for work and have a 65 mile round trip. It will totally suck at first but you'll get used to it with in a week or two. The most important thing is going to bed early. I have faith in you!

Right.. I'm aware of that.. however, what I can't get used to is the three hours a day I would have to spend with my children. One of those kids already went through altering her schedule because she wasn't getting enough time with us at home. For me to do it to her is not acceptable.

Trust me, if it were just Byron and I, this wouldn't be such a big deal. But the fact that I have two kids that are a factor in this equation changes things. I have obligations to them as well as to a work place...

I know that now isn't the time to be even in a position where you might get unemployed.. but there are hospitals much closer that are hiring, and I work in a field that doesn't have as many qualified persons to fill the gaps.

See If you can shift your duties. I know that there would be stuff to do in the office at 630 if thats the time your there. Actually I think thats the Time I was starting on the weekends when I worked at a Vet. they may be duties that are below your current pay grade, but if you can start earlier (Like 630 when you arrive) and leave earlier it may work out.

I have been in a job where I was out of the house 15 to 16 hours a day, its no good. If you have to do it for a while take down time on the weekends with your family.
