As of 2004 smartphones are an increasingly large part of the mobile phone market. Apple doesn't give you a free or discounted iPod in exchange for a legal contract that you will buy a certain number of iTunes Music Store songs per year.

Unfortunately the iTMS makes almost no profit, it's purely a service to make high-margin iPods attractive. You'd have to commit to thousands of dollars in song purchases for it to look like a financially advantageous deal to Apple.
