As of 2004 smartphones are an increasingly large part of the mobile phone market. According to analyst house Canalys: smart phone shipments increased over 100% from 2004Q2 to 2005Q2, with over twelve million devices shipped in the latter period. Apple doesn't give you a free or discounted iPod in exchange for a legal contract that you will buy a certain number of iTunes Music Store songs per year.

Unfortunately the iTMS makes almost no profit, it's purely a service to make high-margin iPods attractive. You'd have to commit to thousands of dollars in song purchases for it to look like a financially advantageous deal to Apple.
