Something that I feel should be passed around for the benefit of those affected by Prop 8's probable passing. Please link this wherever you can; amidst all the political mudslinging from both sides it's a simple and powerful statement that needs to be heard.

Interestingly enough, should Prop 8 go to the Supreme Court - and it will - there's a good chance it'll be shot down there. If you've read the actual proposition, it's INSANELY unconstitutional (I guess they didn't learn from their last proposition). And that would be a much bigger victory for homosexual marriage then Prop 8 not passing could ever be.

It's a bit more complex than that, since it's a constitutional amendment, unlike the last one. The issue is what to do when two parts of the constitution conflict.

...of course, in some states they just deal with this by adding stupid "despite previous amendment" clauses to new amendments, but maybe they didn't do that in this case, or maybe that doesn't fly in California.

Proposition 8 supporters vow to defend the law in court, saying the legal challenge is an attempt to undermine the will of the voters. They view the measure as no different from past voter changes to the constitution, such as restoration of the death penalty.

So... when the will of the people speaks, it's really, really stupid?
