Perhaps Beyond Birthday is trailing Light and Raye Penber as part of a plot to prove himself better than L, and perhaps Mikami entered the series much earlier than in canon and is already a willing pawn of Light before Raye Penber's death (maybe Mikami is pulling off the subway scene gambit instead of Light?). Or whatever other justification you can think of.
