My parents need a new insurance company

Quick background story to this post: My mom was in an auto accident, and my parents' car was totaled. The person doing the totalling was some stupid bitch that was a) driving on a suspended license and, b) uninsured because of said suspended license ( Read more... )

I'm very sorry to hear about your parents and thank goodness they're both all right.

The only thing I really have to suggest is, have they looked into whether or not their state has uninsured motorist coverage? Some states do, that covers people who are hit by irresponsible idiots like this. It might cover the deductible. They can also take this woman to small claims court--they absolutely have a claim against her. They can get free or low-cost legal advice if they go through Legal Aid. (Usual disclaimer: I am not a lawyer, nor do I play one on TV, and I know nothing about what your parents' policy actually said, but if they think they're being treated unfairly by the company, they should ask a lawyer to look into that too. I'm not sure whether the court date was for the accident or with the insurance company...)

Hm... Good suggestions. I'll have to look into it. I know their policy has uninsured motorist coverage (or is supposed to, or whatever), but I might look to see if there's something else that can be done when the insurance company is being an ass and not wanting to pay up.

I'm trying to get my mom to call and see if they'll deduct the deductible from whatever they'd pay her and send a check for the difference. She doesn't think she'll get anywhere with that, so doesn't want to ask. But hey...the worst they can say is no, right? We'll see if she bothers to do it, or just eats the loss. :/

I might mention it to dad, too - maybe he'll be able to get her to call.

The hearing was because they were wanting to cite (site?) her, as well. They cited both her and the uninsured driver, even though the witness statements from the scene made it pretty clear that my mom wasn't at fault and that she couldn't really do anything to avoid what happened. They had proof, and they still cited her. I don't think the other driver was there.
