I noticed 'foxhunt' didn't the hunting act of 2004 make it illegal to foxhunt in England?

Yup. Now hunts follow (or claim to follow) artificially laid trails (which is technically called drag hunting, but that sounds way less sexy). The rest of the traditions surrounding foxhunting remain the same. There are dozens and dozens (over 100, I think?) of active hunts in the UK.

It might add an element to this fic (or another one) if Sherlock and John were investigating illegal hunts with dogs.

Honestly the point here was not so much the plot, but using the setting as a device to bring these two together. But yes, the world of hunting is rich with plot possibilities!
