Here's my shiny new icon, made by neitherday. Thanks for the big f-you to the trans community, HRC. Oh, and way to support all the lesbians and gay men who experience job/workplace discrimination not because of who they sleep with (because nobody knows that for sure) but because of how they express their gender identity.

::sigh:: I'm torn. On the one hand, obviously the changes to the law suck suck suck and piss me off immeasurably. OTOH, I'm not *completely* immune to the argument of taking small steps. I...I don't know.

I mean, in a better world, the proper version of the law would have been passed years ago and we wouldn't even need to have this conversation. Arg.

I guess...hell, I don't know what they should have done. I can't understand the mindset of the opponents to the law, so I just don't know. Arg doubled. Hell, tripled.

Why? I mean, why? Who fucking *cares* about whether you're male, female, both, or neither? What does it *matter* to anyone?

See, I think the small steps argument is obviated by the recent successful passage (through the House) of the Matthew Shepard Act - which would expand the federal hate crimes protections. The Shepard Act not only includes sexual orientation and gender identity, but also perceived gender, and I think it's expected to pass the Senate. Now, Bush will probably veto it, but he would do that even with just sexual orientation included (same as with ENDA).

Most national LGBT organizations opposed the version of the law that did *not* include gender identity. This is not the first time HRC has gone against those organizations and upheld a position that exludes trans folks. Plus, as I mentioned, the version of ENDA with gender identity is better for lesbians and gay men who vary at all from the gender "norm".

Unfortunately, the gender binary matters to everyone. We're all caught in it, and we're all taught to enforce it.
