California Supreme Court Decides Doctors Can't Deny Fertility Treatments to Lesbians

Yesterday, the Supreme Court of California, which was divided on the gay marriage issue, unanimously voted in favor of Lupita Benitez, allowing her to go forward with her lawsuit against a fertility clinic that denied her fertility treatments based on their religious beliefs.  This was doubly problematic as the clinic that denied treatment was the ( Read more... )

Hmm, I'm going to have to agree that in this case anti-discrimination should come before freedom of religion. If you're not willing to treat everyone equally in a medical or health care organization, then you're in the wrong profession.

I think it would be nice if her health care would be accepted at another clinic as well, that way the other people wouldn't be forced to treat her. Though, I agree with Miss: if you're in the medical field, you don't really have room to make moral judgements.

Some claimed she was denied because she was single. It just proves my point that there is discrimination against single people in this society, which I've been stating all along.
In terms of the case, this is the problem with privatized health care. If it were universalized and federally regulated, then the separation of church and state would have prevented the dr.s from denying her based on religious grounds. Personally, I think it has little to do with religion and more to do with gay/ lesbian discrimination.

I wouldn't hold my breath on the Nov. initiative though. Now it's up to the voters and although Calif. is a blue state, conservatives tend to vote more than liberals. I'd like to see it legalized, but I don't trust the voters and wouldn't be surprised if it didn't.
