"CNet doesn't get it" vs. fair use

CNet lifts a photographers image from Flickr, editor (who admits a fuzzy understanding) claims use with a news article is "non-commercial."

Somehow, I doubt Declan McCullough is aware of this.

[Edit]: Apparently, it's gone into "Fair Use" territory and the photographer considers the matter over, albeit not with the resolution I think he would ( Read more... )

ya know, flickr is going to get some bad bad bad press out of this eventually.... hmm..... who would have the power to bring this info to the press? :::tapping chin::: wonder wonder wonder...

But how is it _Flickr's_ problem? I think they can do some education and that's about it.

Flickr isn't sending links to people's photos saying "stealz this pleeze." Other people are browsing/searching Flickr. And that's not going to be stopped.
