I can't believe they spent millions of dollars prosecuting this case to begin with.

From the start it was clear that they would be able to prove Phil was a lunatic gun nut - but not that he pulled the trigger.

Almost any cop will tell you that if two drunk, coked up people are alone in a room with a gun and one of them gets shot it's almost impossible to prove that the other person did it - unless gunshot residue is found on their hands, which in this case it wasn't.

So, lacking that, it's a he said/she said situation with her being too dead to say anything.

It's almost a textbook example of reasonable doubt.

It's really irresponsible to prosecute a murder charge on that basis.

Instead they should have charged him with reckless endangerment - which he was certainly guilty of - but they didn't want to do that and have it look like they were soft on crime.
