About a month ago, my husband and I moved from our apartment to our new house. I turned in the keys and they said they would contact me about the security deposit ( Read more... )

Ah the second post about Chandler in two days, love it. I'm in Mesa.

If the complex is owned by a bigger company, like...Arizona Community Management or something like that...contact the company themselves. Keep calling. You want your money back after all.

If none of that works, call consumer reporters on Channel 3 or something!

Howdy neighbor! I live in North Phoenix now. It is owned by a bigger company, which I may have to contact. I'm going out of town tomorrow and this is NOT something I want to deal with. Thanks for your suggestions! :)

I live out in Tempe!!! I think some of the apartment complexes out here are a little extra shady. My ex and I moved out of our old apartment a year ago and because we had just got 2 kittens before we moved, they kinda made a mess of our apartment (one of them pooped under the bed and we didn't know until we moved out!) Anyway, our securtiy deposit was something $300, so my ex told them to keep it to cover the cost of the damage. Well, they called us like 3 weeks later saying that there was way more damage then when we told them and we owed them $500! My ex knew they were lying because we walked around that apartment after we got our stuff out a noted everything that was damaged.

small claims court.

Unless they can PROVE that you did damage to the unit, then they HAVE to give you the deposit back...it's the law.

Hopefully it won't have to come to that. *fingers crossed*

Find out what the law is in your state regarding security deposits. When we lived in WA state, the law was that the apartment complex had to either give us our deposit back or a letter stating why they didn't within 14 days of recieving the keys. We had one apartment we moved out of that didn't send the letter until day 15 and we took them to small claims court and won all of our deposit back, even though there was definitely damage to the place that we caused. :) AZ may have a similar law, small claims court is a fairly painless process. Good luck!

I agree with polylizzy definitely file with civil claims court.

First send them a formal letter (save a copy of it and request a return receipt). Then file a civil claim if they ignore you. Depending on how long they make you wait, civil claims courts will often award you more than just the direct deposit. For example, in Boston they will multiply the amount by the number of months that you had to wait for your security deposit.

Good luck!

Thanks for that information. I didn't know that.

No problem. Hopefully it won't have to go that far and you'll be able to get your money back the next time you call.

Hmm. Seems a little shady that they didn't let you know before this point. Maybe they were hoping you would forget. But I doubt they still think they're gonna get away with it, now that you've called and established that you remember.

Yeah, the manager should have gotten back to you today, but potentially he is busy with several similar issues and may have gotten tied up. Sometimes 'the manager will call you back' means sometime in the next couple business days. That said--I'd call tomorrow and follow up. And keep calling until he's available.

Good luck.
