National Figure in Election Integrity to Speak in Tucson

Time: 2 pm Saturday, September 16, 2006

Topic: “Will your vote REALLY count?”

Speakers: Jim March and John Brakey

Mr. March’s experiences in election integrity issues is national in scope. He is known as a specialist in the issues surrounding Diebold Elections Systems Inc. and was the lead plaintiff in a California consumer protection lawsuit that netted that state a refund from Diebold of $2.6mil, the first such consumer protection suit ever against a voting system manufacturer.

Mr. March has of late published research and analysis of an apparent failure in the certification process for the Diebold touchscreen product line. If this research and evidence is substantiated, it may have the effect of invalidating the certified status for the Diebold touchscreen product line. Put another way, if Mr. March is correct, the basic legality of a large portion of Diebold’s product line would be called into question as they may not meet the legal definition of the term “voting machine”. As John Brakey, special task force leader for the AZ Democratic Party Election Integrity Committee put it: “We have a particular interest in the back door Diebold put into the central tabulator. A back door allows a person to modify the vote count in a hidden or secretive fashion by way of a deliberate software flaw that violates basic computer security. That central database of votes is far too simple to tamper. We think that if anybody has a chance at catching such access it will be Mr. March or the people he is training locally. Such oversight will require the cooperation of elections officials, and if getting that cooperation requires court orders, we’ll get them. Pima County elections head Brad Nelson has proven himself thus far to be a committed opponent of transparent processes. I heard him lie on the witness stand in the Oro Valley court challenge where he claimed not to know of any Diebold back doors when over a week prior he had admitted knowing about it to myself, Mr. March and Donna Branch Gilby, chair of the Pima County Democratic Party. And I have the transcript to prove it. We look forward to using Mr. March’s technical expertise to conduct a meaningful conversation about valid citizen and party oversight of the elections process in Pima County.”
