It MIGHT not be as dumb as it sounds. Might.
Here is a response from the CPSC that seems to indicate that you can resell items that aren't tested, but if you do sell something that does contain lead, you will be in violation. I doubt many enforcements will be handed out though as testing as much shit we resell is quite impossible.
