Yes, legally that's very different. I'm not so sure it's so different on a moral level that Playboy of all companies is allowed to lecture people on morality.

It may not be that the nursing home didn't understand probability as much as it DID understand regulators. If a patient felt to be at low risk of suicide then attempts suicide or worse "succeeds" that nursing home is going to be in a world of hurt with the regulators. Anything negative that happens to a nursing home patient in the USA is assumed by state regulators to be due to abuse or neglect by the facility and its staff. Families assume the same thing. And families act on that by suing.
