Heh, no. Check the timestamps.

This is because in the last few months I have heard the rationalization that "It's fanfic, we're all plagiarising" or some variation thereof to handwave away the idea that the whole concept is bad/dirty/wrong and not in that wholesome porny way.

That rationalization is very stupid, and I'm glad you've said so. This whole thing though is...so complicated. And even if we arrive on some sort of "solution," it'll just cycle back in in a few more weeks/months/years. Le sigh, fandom. Le sigh.

Exactly, rationalization using faulty logic so they can go on either doing it themselves, or can go on enjoying the fruits of such labor guilt free.

It's wrong.

Yes, fanfic skirts a line, but in general it never claims the universe as the writer's original idea.

Well, actually, although I understand the gist of your argument, Plagiarism is a form of copyright violation.

the deal is this -- and this is where the argument gets misused: all plagiarism is copyright violation, Not all copyright violation is plagiarism.

i.e. I can write fan fic and be possibly guilty of copyright violation (outside of fair use) but not necesarrily guilty of plagiarism.

*facepalms* I knew I forgot the umbrella argument.

My original argument still stands, because fanfic in general is not plagiarism, but plagiarism itself IS copyright violation.

Yis. Hee! I actually was pretty sure you understood the distinction, but not so sure anyone who hasn't had this argument a bazillion times would.

Which you know is why we have it a bazillion times a year becasue folks don't understand the basics.
