Considering that the 'Finder' episodes are supposed to air before 'Bones' comes back in spring, I guess there will have to be a hiatus. I wonder if the late season premiere means they've cut back the number of planned 'Finder' episodes, though.
I'm excited, b/c it means no MLB hiatus and more back to back eps.. better for the flow of story.. SN has been saying btwn 13 & 18 eps for next season.. this gives them the flexibility to make it happen..
If filming starts on July 15 (mid-July being the usual return to set date, if memory serves), they have approximately 7-ish weeks before ED goes on mat leave. Which gives them time to film about 5 or 6 episodes, depending on how long they take to film a single episode).
I'm not sure how long ED will take for a leave - though, I believe US legislation only allows for 6 weeks (I won't comment on that, except to say that in Canada, it's a year) - it's possible she may be back by November or December. And they may film quite steadily through the winter months, taking a two-week break or so for the holidays. I don't know if the season will need to be reduced by all that much, if at all. At any rate, there will less downtime between episodes.
However, I understand it's frustrating for fans to have to wait until November. But ED is pregnant. It's not like she's decided to take an extended trip around the world. Or something equally frivolous. I can't fail the producers for accommodating this.
The Family Medical Leave Act (federal law) mandates you can take up to 12 weeks *unpaid* (or a combo of unpaid/paid if you can take your own sick leave that you've saved up) leave (based on employers with 50 or more employees) as long as you've worked 1250 hours in that year. That will guarantee you a compable job at the same pay when you return.
However, there can be state laws that differ and union contracts (like SAG) can have their own stipulations that can be different. And in the case of lead actors of a TV show, I would say their contracts are even stiffer. However, since ED is a producer of the show, she probably has a pretty damn good contract.

I think if a network orders a set number of episodes you do those set number of episodes.
