Ahem.  The book is 'Criminial Justice Through The Ages'', translated by John Fosberry (no specific author given; it's a product of the Mittelalterliches Kriminalmuseum in Rothenburg ob der Tauber, Germany.)

"If the plaintiff decided to kill the offender, these proceedings insured that the latter's family could not take vengeance on the plaintiff and that the plaintiff was not required to pay a fine.  While the capture of a fleeing offender was recognized at an early date as "in flagrante delicto", as already mentioned, this concept was later extended to the search for the offender, mostly a thief, including the following up of clues and house-search.  In a house-search, however, strict formalities had to be observed on account of the great importance attached to the domestic peace.  This extension of the concept "in flagrante delicto" also modified the importance of the oath-swearing neighbors.  They had to inform the court about the pursuit and capture of the offender, and gradually they became witnesses in the sense of modern law."

What?  It's an interesting book!  And I had dug it out to help a friend who was considering doing an interesting SCA A&S project.  So there.
