Misericordia, part two: The Plot Thickens

It's not as if JM didn't know I would do this; I've warned her. And she knows what happened to the last former employer who messed with my pay, but to date, I have not received my outstanding holiday pay. Did she think I'd give up and go away? She must think denial is a river in Egypt, because her response to correspondence from the CLA has been nothing short of bizarre: after sending me my P45 (tax document after cessation of employment), she's only gone and passed my details to a colleague of hers, who called me up to ask for a copy of my CV! What - after they pulled me from the assignment for being an awful temp (allegedly)?

Well I told C- that I would send her my CV (which I've done), but she has a right to know I am in dispute with the agency because they owe me my holiday pay. I was promised pay in lieu by the bank because they would not let me take my annual leave within the holiday year set by the agency for staffing reasons. The fact that I couldn't take the leave in time and the offer of pay in lieu has been noted in email correspondence and forwarded to DS, my lawyer, as evidence. I explained that the deadline is today, and DS has given JM until tomorrow to respond. If not, she will launch a case to be heard at a tribunal. C- knew nothing of this, and said she would refer the matter to the legal department. I bet that's the first they've heard of it!

That stupid woman could lose her job over this - but all she had to do was give me my holiday pay! I did say I would go to the Daily Mail over this if I had to. Come tommorrow, end of business, if there ain't no resolution, the paper that hates the bank I was working for on assignment for the agency will be given all the evidence. The agency is most likely to lose the contract over this, and it's all JM's fault for not paying what she owes me.

It's mean, I know, but they owe me £400, and this close to Christmas, I'll have their hides if they don't pay up! Besides, I have received correspondence to the effect that I'm not the only one they've done this to. Can you see how big a can of worms this is? Well, I will blow it wide open if I don't receive what I am owed. Sorry, JM, I can't help you at this time.

Just sayin'.

Update: I got an email today to the effect that JM claims I never discussed my holiday entitlement with her. The lying cow!! I told DS by reply that I had at least two witnesses, and I would swear on oath that we did discuss it, and that JM and L- were witnesses thereto. If I was really evil, I could get ML involved, too. That little snake deserves to be held up to scrutiny! In any case, JM is PWNed by the date of my P45 - 25th September, 2009 - before the end of the holiday year. Her ass is grass!

Update #2: DS is going to call C- to find out if the legal team at the agency knows anything about this. JM is in deep, deep schtuck now.

Update #3: 14/12/09 It's going to tribunal. DS is drawing up the paperwork as I write. I've emailed the Daily Mail and the Manchester Evening News. JM is still lying about discussing holidays with me. We DID discuss it, damn it! *Watch this space.*
