Well, I think we can safely say he did steal it, directly or indirectly - perhaps through one of his many studio slaves. I seem to keep arguing the same point with the few naysayers I've come across the forum and youtube (on Myspace people don't seem to argue with me - in fact, many are helping me spread the word!):

The bassline sounds a little different because it's been processed through distortion and a low pass filter.Still, it is the same actual bassline, sampled from the original.
The melody has been kept, as is, from the original. Just like that.
So what does Timbo and Nelly's effort has that isn't from the original? Some generic hiphop drum loops and her inane warbling (which funnily enough she uses the notes from the original melody for).
Not many people go on about how he used the whole thing a year before for an exclusive/expensive Timbaland(TM) ringtone as well...Whoa Nelly, your producer recycles his ringtones (which are stolen in the first place) to fill out your album, why?!
