Aug 18, 2011 13:24

A woman currently serving 36 years in prison for murdering her autistic daughter is seeking a new trial, claimng misconduct.

In 2006, Karen McCarron was arrested for killing her 3-year-old daughter, Katie McCarron, by smothering her with a plastic bag. McCarron was convicted of Katie's murder in 2008.

Karen McCarron is petitioning for a new trial. She claims her attorney was often drunk during the course of the first trial. She also says her attorney allowed testimony, including McCarron's reported confession, that should have been inadmissible.

McCarron's old attorney denies her claims.
